What Is Workers’ Compensation?

Worker’s compensation is a state-mandated insurance program that provides benefits to employees with work-related injuries or illnesses. These benefits include payments for medical bills, partial wage replacements, and compensation for permanent impairments.

What Injuries Are Covered?

According to the Louisiana Workforce Commission (LWC), both mental and physical injuries are covered by law as long as they are the result of stress or accidents at work. The law also covers occupational diseases like lung cancer caused by the inhalation of asbestos.

There are two things worth noting:

The Louisiana Workers’ Compensation Act defines accidents as “an unexpected or unforeseen actual, identifiable, precipitous event happening suddenly or violently, with or without human fault, and directly producing at the time objective findings of an injury which is more than simply a gradual deterioration or progressive degeneration”.

Note that employees are not entitled to benefits if they did anything with willful intent to injure themselves or others, or if the injury was the result of drug or alcohol intoxication.

Who Is John D. Ray?

John D. Ray is the owner of The Ray Firm, and he has specialized in workers’ compensation throughout his career. He served as a mediator for the Louisiana Workforce Commission and the Office of Workers’ Compensation, and as an Assistant Attorney General for the Louisiana Department of Justice.
